Telecommunications Act of 1996 was intended to open up markets to
competition by removing regulatory barriers to entry for
telecommunications carriers. 15 years later, the City of Santa
Monica and its businesses are realizing the benefits of the
legislation with Santa Monica’s successful municipal broadband

Santa Monica City Net, the city-owned and operated 10 Gigabit fiber
optic network, has received overwhelming support within the local

exciting projects for any PEG Station is building your own facility. Whether you
are starting from scratch, remodeling an existing building or just upgrading
what you have, it takes good planning to come up with a facility that meets your
production needs and stretches those valuable dollars!
Our panel
discussion will cover the planning, options, choices and decisions that go into
constructing a PEG Facility. From space planning, sound proofing and
infrastructure to paint finishes and ladders tall enough to reach the lights,
this session is your chance to see what goes into making these sometimes
once-in-a-lifetime opportunities come to fruition!

include Story Telling, Lighting and Audio Workshops.
Our Spring
Conference is coming on June 3rd at our new venue in
beautiful Long Beach, California!
This year’s
programming tracks are designed so that those of us who run community
cable channels will want to bring everyone on our staff to the
conference. This will be a great training opportunity with something for
everyone, plus we will have all the latest gear from NAB at our Trade
Show as well.
Of special interest
will be our Story Telling Workshop with Les Rose. What makes a TV
program great is a great story! This all day workshop is for producers,
reporters, editors and more. They will see many examples of good story
telling, get ideas for how to shoot and produce the stories, and get
tips on editing the pieces together to weave together a compelling
story. In addition, reporters can bring their demo reels to get feedback
on their pieces. Les’ tips are simple and practical and are easy to
implement. He shows how to keep the audience interested and engaged in
your message. This is a worthwhile investment for all of your staff
involved with producing content for your channel.
In addition, we have
brought back Bill Holshevnikoff to do his all day Power of Lighting
Workshop for us! This workshop will help veterans and beginners alike.
Bill has many tricks up his sleeve to do great lighting quickly and with
a minimum of equipment as needed. After going to his workshop, your
field production crew will be looking for situation to try their new
lighting techniques!
Each of these
workshops is being offered this year at the SCAN Spring Conference at a
price that is much less than what you would normally pay to get this
type of training!

SITING UPDATE
The
world of wireless siting continues to be a mix of new entrants, new
technologies, and new litigation. SCAN NATOA presents a practical overview
of the wireless siting process for local government and private planners,
and public and private attorneys. You’ll learn about the latest court cases
shaping this changing landscape, and planning processes designed to deal
with the federal and state laws that control wireless siting. Included will
be an overview of Clearwire Communications, a new wireless Internet player
poised to enter the Southern California marketplace in a big way.

PHOTOJOURNALIST LES ROSE
Calling all
photographers, producers and writers! SCAN-NATOA presents a
story-telling workshop with award-winning CBS News photojournalist Les
Rose. Part of the famous CBS News team of Steve Hartman and Les Rose,
the two traveled around the country and could come up with a story on
virtually anything. Their most popular series called “Everybody Has A
Story” produced stories on people whose names were pulled at random from
a phone book! They learned everyone is interesting in some way and you
don’t need the most expensive equipment or a team of news professionals
to get a great story.
Les Rose will show you how
you can do it, too. He’ll teach you the importance of character
development, how to improve writing and lighting, and the value of humor and
heart in a story.He’ll give you samples of his work and pass along his
broad experience from covering stories all over the world. They range from
9/11 stories in Pennsylvania and New York City, to natural disasters to
celebrity interviews. He’s made presentations to The Poynter Institute,
N.P.P.A., RTNDA with Al Tompkins, NATOA and many other organizations around
the country. Don’t miss his SCAN-NATOA presentation; it will be the best
video production training session of the year.

California law permits local entities to receive a franchise fee of up to
5% of gross revenues from State-franchised video service providers. The law
also permits the local entity to receive payments to support PEG channels
and facilities.
How can
a local entity be certain that it is receiving the correct payment(s)? What
are the options and issues that local entities should consider? Can you
require the use of standardized reporting forms? What types of
non-disclosure issues might be raised? How often can audits be performed?
How are “gross revenues” defined? What is the recourse if underpayments are
found? Are these issues the same for franchise fees and PEG support? Are
there benefits when cities work together on audits and audit issues?

NATOA will be holding a workshop on October 23, 2008 at Cerritos Park East
to discuss these and other related issues.

The California
Public Utilities Commission (CPUC) has begun to issue video service franchises
to incumbent cable operators. The first State authorizations became effective
on January 2, 2008. Most of the applications received by the CPUC cover
jurisdictions where the local franchise has expired, but in some cases the cable
operator has abrogated the existing local franchise agreement as permitted by
State law.
All of the major
cable providers in the State --- Charter, Comcast, Cox and Time Warner – have
applied for and received State authorizations for some of their service areas.
Additional communities will be added as local franchise agreements expire or are
abrogated in response to competitive video offerings from State authorized video
service providers.
SCAN NATOA
(the States of California and Nevada Chapter of the National Association of
Telecommunications Officers and Advisors) will hold a workshop in Walnut Creek
on Tuesday February 5 from 9:30 - Noon to answer questions about the opening of
the state-issued franchise process to incumbent cable operators under California’s Digital
Infrastructure and Video Competition Act of 2006 (DIVCA).
Experts on
the rights of Cities and Counties under DIVCA and representatives from Comcast
will speak on this timely subject, and will answer your questions about the
transition to state franchising.
Issues to
be addressed at the workshops include:
ØWhen may a
cable operator apply for and receive a state-issued franchise?
ØWill
Cities receive notice that the operator is seeking a state franchise?
ØWhat
happens to the obligations under a local franchise once the operator applies
with the CPUC?
ØWhat will

Last year California’s legislature adopted AB2987, the Digital
Infrastructure and Video Competition Act of 2006 (DIVCA), which made
sweeping changes to cable franchising in the state. Subsequently, the
California Public
Utilities Commission adopted rules to implement the new law, and statewide
cable franchises were granted to AT&T and Verizon. ACM West and SCAN-NATOA

IMPLEMENTATION OF STATE VIDEO FRANCHISEE PEG REQUIREMENTS
The States of California and Nevada Chapter of the National Association of
Telecommunications Officers and Advisors (SCAN NATOA) and the Western Region
Chapter of the Alliance for Community Media (ACM) will hold two workshops on
issues which have arisen, and likely will arise, regarding the
implementation of the PEG requirements of California’s Digital
Infrastructure and Video Competition Act of 2006 (DIVCA).
Based
on preliminary communications with State Video Franchise holders, it appears
that local governments and the franchise holders may have different
interpretations of the PEG requirements of DIVCA. In some cases the
proposals for PEG provided by the franchise holders are contrary to the
requirements of the law.
The
workshops will be open only to Individual Members of SCAN NATOA, or

How the Swaparama works:
Programmers, including other government cable channels, are asked to provide
programming that is evergreen and can be aired by other channels.
50 DVDs of each show are made and then are made available to the Swaparama
attendees. Up to 50 channels can participate and each can take one set of
each program. We try to acquire series so that you can set-up weekly time
slots or strip the program.
This is a great way to fill up your PEG channel by attending one event!
It is worth the time and airfare just to get the shows. The cost to attend
the event covers the continental breakfast and helps to defray the costs of
providing the DVD copies to each channel.
This event is done by volunteers and is a non-commercial service of SCAN
NATOA so you must attend the Swaparama in person in order to get the shows.
We do not take phone or e-mail requests for programming so please just come
to the event and take advantage of this opportunity to get loads of
programming!
Programming acquisition and distribution is coordinated through Robin Gee at
CityTV in Santa Monica. If you have programs you would like to share, please

to approximately 30 participants per location so that the specific concerns of
those in attendance may be addressed. You may wish to bring copies of your
franchise documents to help facilitate the discussion.
The meetings will be open
only to Individual Members, or those who are eligible to be Individual

discussion regarding the January 17, 2006 decision by the Ninth Circuit
Court of Appeals in Sprint PCS v. City of La Cañada Flintridge. In its
ruling, the Court found against the City in interpreting the
requirements of California Public Utilities Code §§ 7901 and 7901.1 and
Federal law to determine that aesthetic concerns are not valid reasons
for denying or conditioning permits to wireless providers:
“While the authority to restrict
building on ‘time, place, and manner’ gives cities more authority to
determine what constitutes a reasonable use of the road, this language
does not seem to greatly enhance the City’s regulatory latitude –
certainly not to the extent necessary to engage in aesthetic
regulation.”
The potential impact of this ruling may
extend beyond wireless service providers, and may include wireline and
cable companies.

This session is
participatory! We invite you to bring your recent examples of election
programming to share with the group. The group will give feedback about
the programming and its effectiveness.
After a brief lunch,
we have invited former Santa Monica City Council candidates, Michael
Feinstein and Patricia Hoffman to join us to see the clips we think are
best so they can give us their feedback from the candidates perspective.
Both have participated in all of CityTV of Santa Monica’s extensive
election programming.
This is a workshop
where we will brainstorm and try to come up with new formats and new
ideas to keep election programming looking watchable and relevant on our
channels.
We will also have
representatives from the Center for Governmental Studies and hopefully
the League of Women Voters there to advise us on whether our formats are
impartial and unbiased.
There will be plenty
to see and discuss!

Creek there will be less of a focus on Verizon (no operations in Northern
California). In Carson, we will be a bit more expansive on the discussion
of Federal legislation and regulatory activities in order to take full
advantage of the participation by Lori Panzino-Tillery.
We also wish for this to be a roundtable discussion, so please bring
copies of any relevant materials that you may think will be of interest to
the group.
The meeting will be open only to Individual Members, or those who are
eligible to be Individual Members (meaning that you must either work for
or represent a municipality). Please share this information with
others who may be interested in attending, including those who are
responsible for establishing local policies as well as issuing
construction permits.

More details: All
programming distribution will be done on DVD. You will be required to give
your contact info for each program that you take so that the programmer
can follow-up with you to get airing information and maybe to even give
you more shows! Some programmers will require that you sign a program
agreement at the event prior to taking the show. Others may require that
you provide web links or other promotion for their show if you take it.
We will screen all the
available shows at the event so you can know which shows you are
interested in prior to taking the DVDs. We plan to have adequate DVDs so
that you will receive a copy of every show you are interested in.
This is an in-person
event so you must be present to select and receive your programming. If
you are a start-up channel or a channel that utilizes a lot of outside
programming, it is well worth airfare to come to this event since we plan
to have upwards of 200 shows by the time the event happens. We do not plan
to fill any orders via mail or e-mail at this time since this is a
volunteer effort done by SCAN NATOA. If there are copies of shows left
over after the event, we will decide what to do with the leftover DVDs at
that time.

Attendance at the meeting will be limited to Individual Members, and those
who qualify to become Individual Members. This means that only municipal

The
near future may involve vigorous competition between telephone and cable
companies, but it may also involve no cable franchise fees, no community
access and no consumer protection. Whether you are a regulator, a
programmer or from the industry, you can’t afford to miss this important
seminar.
The FCC
just ruled that “voice” delivered using Internet Protocol (VOIP) is not
subject to local regulation and has suggested that video delivered using
IP also should not be subject to local regulation. This could result in
the eventual loss of local franchising authority over cable, including
losing PEG access channels. Meanwhile, Verizon and SBC have recently
announced plans to rebuild many of their local networks to deliver voice
and video over IP. How does this technology work? What are you going to
do when they show up at your permit counter? What changes in State law
should be made to encourage competition and deployment by the telephone
companies while protecting the public interest? What actions should local
government be taking to ensure that our interests are protected at the
federal level?

This meeting is

focus on the latest developments related to Comcast. Comcast
representatives, including Debbie Lupold, the new Division VP for
Government Affairs for the Western Division, will attend a portion of the
meeting to discuss the Western Division reorganization, the new privacy
policy and Comcast's position on PEG and renewals. We will also discuss
the San Jose litigation regarding the City's preliminary denial of a
franchise renewal, the status of other local renewals, telephone
performance reporting, and franchise fees listed on subscriber bills. The
session will be moderated by John Risk of Communications Support Group.
